Assignment Description

For each of the six principles of administrative law, define and explain how it applies in practice.

1.Principle: Decision-makers who exercise powers granted by statute (administrators) must stay within their legal authority, or jurisdiction.

2.Principle: Administrators must exercise their judgment in a reasonable manner when they have discretion in making decisions.

3.Principle: Administrators must follow fair procedures when making decisions that affect a persons rights or interests.

4.Principle: A person to whom the legislature has delegated authority to carry out a function may not delegate it to someone else.

5.Principle: To be valid, subordinate (or delegated) legislation must conform to the statute under which it is passed.

6.Principle: If decision-makers violate any of the above principles, the superior courts have an inherent power to intervene to rectify this failure.

Assignment Steps

1.Review the assignment instructions and rubric to ensure you understand the requirements and expectations.

2.In memorandum format, draft your submissions. Adopt the structure of the questions and deal with each part separately.
Submissions should be double spaced, 12-point font, 1-inch margins and a maximum of 5 pages.
The assignment should be no more than 4 pages.

3.Ensure that your documents are presentable to the reader. For example, proper formatting for the type of letter you are drafting.
